The Maryland Condominium Act has had a recent amendment in regards to the statue of limitation on condominium construction defect claims. The bill was written by Nicholas D. Cowie who specializes in construction defects in condominium associations.
The new law will stop developers from shortening the time period in which legal action must be taken. Construction defects are not always latently apparent and shortening the time to discover these issues would be an unfair burden on the homeowner or condominium association. The Community Association Institute Maryland Legislative Action Committee (LAC) has not released a full update of 2018 changes and updates to the Condominium and Homeowners Associations Laws. More information will be available soon on the Maryland LAC website.
