The FMCSA has issued some proposals and temporary waivers in order to help motor carriers comply with the agency’s electronic logging device (ELD) rule. The following is a list of the FMCSA’s releases and details about how they may impact your operations:

  • A proposal to eliminate the unladen requirement from the personal conveyance rule. Currently, drivers can’t use their vehicles for personal use and be considered off-duty for hours-of-service regulations if the vehicles are laden.
  • A proposal to clarify how ELD regulations apply to the exemption for the transport of agricultural commodities.
  • Limited, 90-day waivers for motor carriers that transport agricultural commodities, rent or lease vehicles for 30 or fewer days, or use the PeopleNet ELD system. Carriers with an industry-specific waiver must have a satisfactory safety rating from the FMCSA, and all carriers that use a waiver must notify the agency within five business days of an accident.
