In August, Delaware Governor Jack Markell signed a bill creating an Office of the Common Interest Community Ombudsman as part of the Department of Justice.
The Ombudsman will receive and investigate complaints regarding potential violations of the law, regulations or governing documents for condominium and
homeowner associations.
When the program is finalized, homeowners will have the ability to lodge complaints with the state in regards to happenings within the community
association.
The Ombudsman will work with an advisory committee. The committee is still being formed. Directors & Officers policies will cover the cost to defend in an administrative
hearing. Associations, Boards and managers may want to explore having a written complaint resolution process within the association to help avoid administrative
hearings and potential claims.
