Currently in Maryland the homeowner of a condominium can be held responsible for the deductible up to $5,000. The deductible is charged to the unit where the claim originates, referred to as the point of origin. This allows the association to pay the deductible if the claim originates on common elements only.
Community Association Institute wants input as the Maryland legislature is considering increasing the amount of the deductible allowed to be charged back to the unit owner to be $10,000.
A unit owner can purchase an HO6 policy that will cover the cost of the deductible as mandated. However, each association should review if it is cost effective for the association and the unit owners to consider this option. Each unit owner may end up paying more out of pocket yearly to transfer this risk from the association to the unit owner. Each association insurance policy should be reviewed with the typical cost of an HO6 policy covering this expense.
